Habeas Data as an Effective Guarantee of the right to Personal Data Protection: Analysis of Ecuadorian Constitutional Jurisprudence

In Ecuador, habeas data is a jurisdictional guarantee provided for within the constitutional framework. This study aims to analyze habeas data according to the jurisprudence of the Constitutional Court. To this end, it addresses the interpretation and application of ARCO rights (Access, Rectification, Cancellation, and Opposition) according to constitutional jurisprudence, the coordination and complementarity between the habeas data procedure and the mechanisms for exercising ARCO rights, and identifies possible normative contradictions between the Organic Law of the Constitutional Court (LOGJCC) regarding habeas data actions and the Organic Law of the Rights of Persons with Disabilities (LOPDP). The study employed a qualitative methodology, using four Constitutional Court rulings as a sample, selected for their contribution to the guarantee under study. The results demonstrate the availability of binding jurisprudence that includes parameters for legal entities with respect to the guarantee, the inadmissibility of corrective habeas data due to controversy, the obligation to observe basic requirements for its exercise, and its development focused on the right to one's image. It concludes that constitutional jurisprudence contributes to progressively consolidating habeas data as an autonomous and effective guarantee, whose material content includes access, rectification, updating and deletion of personal data.
